This module introduces learners to the legal environment within which professionals working with children operate. Learners will explore the constitutional principle of the best interests of the child, key child protection legislation, and the structure of South African courts dealing with matters affecting children. The module provides the legal context necessary for effective professional practice and testimony.

Module 1: The South African Legal Framework
This module introduces learners to the legal environment within which professionals working with children operate. Learners will explore the constitutional principle of the best interests of the child, key child protection legislation, and the structure of South African courts dealing with matters affecting children. The module provides the legal context necessary for effective professional practice and testimony.

Module 2: Court-Ready Report Writing & Case Integrity
Through this module learners will learn how to prepare defensible professional reports, and understand the legal principles governing evidence admissibility, confidentiality, privacy legislation, and information governance.

Module 3: Ethics & Code of Conduct
Professionals involved in legal proceedings concerning children often face complex ethical dilemmas. This module examines professional conduct requirements, statutory codes of ethics, conflicts of interest, and the expert witness's duty to the court. Learners will develop a clear understanding of how to maintain objectivity, professionalism, and integrity throughout legal proceedings.

Module 4: Moot Court Excercise
The Incident You are a respected professional who has been asked to provide expert evidence relating to an incident that occurred at a manufacturing company. An employee was seriously injured when industrial equipment malfunctioned. The injured employee has instituted legal proceedings against the company. An attorney contacts you and requests that you investigate the matter and provide an expert report based on your professional expertise. After accepting the instruction, you receive documentation including: • Witness statements • Photographs of the scene • Maintenance records • Medical records of the injured employee • Company incident reports Some of these documents contain confidential and personal information. Over several weeks, you review the documents, conduct your investigation, make notes, and prepare an expert report. The attorney is pleased with your report and decides to call you as an expert witness. Three weeks before the trial, you receive a subpoena requiring you to attend court.
